Terms and conditions

The following terms and conditions (the "Agreement" below) are designed for e-commerce. Cocolor AB (Org no: 559165-6235) constitutes the selling party hereinafter referred to as TONITON.
You (the "Customer" below) are the purchasing party.
The terms of the following Agreement are intended for private individuals over the age of 18 who reside in Sweden and for the sale of goods (Products below).
To further clarify, the version and date of publication of the Agreement are stated. You as a Customer are given the opportunity to accept the terms when you place your order. Terms or parts of this Agreement that deviate from legislation have no effect unless the deviation works in favor of the Customer. This provision only applies if the Customer is a private person and if the purchase is only for personal consumption.
To shop at toniton.com, you must be at least 18 years old or have received written permission from your parent / guardian.
At toniton.com you can shop products easily and conveniently. We offer secure payment options and deliveries. Toniton receives your order when you click on the "pay" button at checkout, your payment has been approved and you have received your order confirmation via e-mail.
Once you have paid, an order confirmation will be sent to your e-mail address with information about your order. The order confirmation also works as your receipt, so please save it. Should anything be wrong, please contact us as soon as possible at: firstname.lastname@example.org
When we send the e-mail "Order Confirmation", the parties enter into the Agreement. Should it be impossible for us at Toniton to deliver your order, we will contact you immediately. If possible, we will offer you an alternative solution and as soon as you accept it, a new Agreement will be initiated.
Shipping Confirmation and Tracking Information
When your order leaves the warehouse, a "Shipping Confirmation" will be sent to your e-mail address. You will also receive additional emails from the UNIFAUN transport management system with tracking information about your package.
Cancellation or change a purchase
If you have any questions about your purchase or want to cancel your order, contact us as soon as possible. Use or include the same email address you used when ordering and your order number. Contact us at: email@example.com
To be able to cancel a purchase, you must notify Toniton before the order has been packed. Unfortunately, we do not have the opportunity to change any applicable products or quantities on your order. If you wish to do so, we recommend that you cancel your order as above and redo your purchase on toniton.com.
Prices, VAT & Customs
For all purchases within the European Union, prices include your country´s VAT.
Orders are sent based on DDP (Delivery Duty Paid), which means that all taxes and customs fees are included in the total price at checkout.
Countries outside the EU
Your order is sent based on DAP (Delivery At Place), which means that the total price shown at checkout is without VAT.
For international orders, taxes and fees determined by the customs authority in the country of destination may apply. Although this does not always happen, the assessment of duties and taxes will be based on the value of the order and any threshold for tax-free purchases of goods imported into the country of destination. Payment of duties and taxes is thus the recipient's responsibility. Sometimes it can be stated as an extra postage fee.
Unfortunately, Toniton has no control over, or influence over, this type of fee and it is up to each customer outside the EU to familiarize themselves with the regulations of their specific country. More information can be obtained through your local customs office.
We reserve the right to make price changes, technical problems or other communicative errors and reserve the right to adjust our prices unannounced.
All products offered on toniton.com are primarily developed to comply with Swedish environmental and safety regulations. If necessary, instructions are delivered in English.
Colors and product range
We do our best to show our products as accurately reproduced as possible. Because color perception may vary depending on the screen on which it is displayed, we cannot guarantee that the colors of your particular screen will match the actual product. Furthermore, we can not guarantee that the information in our webshop is error-free, therefore welcome questions / feedback regarding color shades and any other matters at: firstname.lastname@example.org
If a Product is marked "Coming Soon", the Product will arrive soon.
If a Product is marked with "Sold out", the Product will be back in stock when we have produced more.

Provider of payment solutions and methods
At Toniton we offer payment by invoice and card (Visa and MasterCard). All card payments are handled by Toniton's partner Klarna, which checks that the card, invoice or bank payment is approved for purchase. All card and personal data information is encrypted and meets all requirements for a PCI DSS and SSL certificate, which means that it is completely inaccessible to an unauthorized party.
If you choose to pay by invoice or partial payment, a credit report is made by default. The information forms part of Klarna's credit assessment and is retrieved when information is missing or an update of existing information is required. Because the information is so-called micro-information, it is not visible to banks or other lenders and does not affect your creditworthiness.

Payment via PAYPAL account
Pay quickly and securely with PAYPAL. You can choose to pay with your PAYPAL credit or via a credit / debit card connected to your PAYPAL account.

Note that you can sometimes have your order divided into several deliveries as we sometimes send individual products directly from our collaboration partners.
Many orders are handled at our distribution center in Gothenburg, Sweden, within two working days, depending on payment approval and availability in stock. We work Monday to Friday, excluding Swedish holidays.
We use DHL Frakt, Schenker, PostNord and UPS as our carriers. The choice of carrier and delivery service depends on the country to which your order is sent.
When your order is sent from the warehouse, a delivery confirmation will also be sent to your e-mail address. An additional email will also be sent to you from the UNIFAUN Transport Management System with tracking information about your package.
The products are delivered either to a parcel delivery point near the address you entered when you ordered your products or to your door depending on the destination. If the carrier cannot deliver your package, it will be returned to our warehouse in Gothenburg.
Note When you receive your delivery, it is up to you as a customer to check whether the package is damaged before you sign the delivery note. If any damage is detected, then carefully open the packaging and check the product. It is then important that this is noted on the delivery point / shipping partner's transport slip / notice. If this is not done, it can be difficult to claim that the damage occurred during transport.
UPS Standard and Schenker
With the delivery method UPS Pickup Point, you get your package delivered to a delivery point near the address you specified when you placed the order. You will be notified via SMS or letter avi when your shipment has arrived at the delivery point. Some larger products or those that are longer than 150 cm (eg larger tables, chairs and carpets) cannot be delivered via the UPS Pickup Point delivery point, these shipments will instead be delivered to your home address.
With the delivery method UPS Home Delivery, you get your package delivered right to your front door on weekdays. You are notified via SMS or telephone and can choose the day and time for delivery within a specified delivery window. It is important that you provide the correct telephone number when placing your order.

A delivery can sometimes be delayed by the customs authority in the country of destination as a random security / inspection procedure. Toniton can not influence or be held responsible for this.
Risk of loss
During transport, Toniton will be responsible for the order until it has reached you. The risk of loss is transferred to you as a customer, as soon as the order has been delivered to you.
Toniton always registers the IP address when purchasing. In that we receive a package back from a customer / recipient who has refused the package, we reserve the right to charge the customer for all costs incurred and add a handling cost of 250 SEK / 250 NOK / DKK 250 / 25 EUR / 25 GBP. The money is automatically deducted from the amount paid for the order. If the cost of handling is higher than the customer's order value, no money will be refunded to the customer. If the customer has more than two uncollected packages, the customer will be blocked from shopping at toniton.com
Returns / Refunds
Right of withdrawal
We want you to be happy with the products you buy at toniton.com. Therefore, we give you a 14-day right of withdrawal from the day you receive your order. Note that the right of withdrawal does not apply to the following products that are manufactured on orders - bathroom furniture, shower glass, switches and paint
A customer who enters into an Agreement as a private person has the right to revoke the Agreement without reason in accordance with the Act on Distance Agreements and Agreements outside business premises (2005: 59). The right of cancellation does not apply to customers who enter into the Agreement in their capacity as entrepreneurs.
All goods in the order must be delivered in order for the deadline for the Right of Withdrawal to begin. If delivery takes place at different times, the deadline begins when the last part of the order has been delivered.
When using the Right of Withdrawal, you as a customer must notify Toniton within 14 days of receiving the product / products. To do this, follow the instructions in sections 7.2-7.4 below.
Instruction for returns
- Important, always contact Toniton before returning any products: firstname.lastname@example.org
- The product (s) must be returned well packaged in our / our original packaging
- Note that you as a customer are responsible for packing the return so that it is not damaged during the return transport.
- You as a customer must be responsible for all costs regarding return shipping. Please note that the cost of return shipping is likely to be higher than the shipping you paid to get the products home. This is because it is much more expensive to buy a single shipment than for those who procure large volumes.
- We recommend that you book a traceable shipment as you as a customer are responsible for the return.
- Keep your receipt as proof until you have received your refund.
We do not have the opportunity to exchange one product for another. However, you can always return the product / products according to the instructions above and then place a new order. Please note that shipping costs are non-refundable.
When using the right of withdrawal or in the event of a complaint that has resulted in a refund decision, the following applies: Once the product has arrived in Toniton, we will refund you within 14 days. If you return fewer products than the total order consisted of, you will only be refunded for the products you have returned. We will refund you through the same payment option you used when ordering.
When exercising the right of withdrawal, your shipping costs are not reimbursed, but the amount for shipping is settled in the transaction for the item sent in return. Note, however, that the shipping cost is always reimbursed in full in the event of an approved complaint. See price list under General Terms and Conditions - 6. Shipping & Delivery

For purchases with payment options KLARNA Invoice:
Log in to KLARNA here or in their app and click on "Report Return" on the invoice in question, followed by "I have returned my goods". Then the invoice is paused and you do not have to worry about it falling due while you wait for Toniton to handle the return.
When Toniton has received the package back, KLARNA adjusts the invoice, after which you will receive a confirmation of KLARNA via e-mail. If you chose to keep parts of your order, you will receive an updated invoice from KLARNA so that you can pay for the goods you have chosen to keep.

If you perceive that a product is not satisfactory in terms of quality, let us know as soon as possible by e-mail at: firstname.lastname@example.org
Please include the following via email:
- A description of what is wrong with the product and one or more photographs that clearly show the problem.
- Enter the order number, the date when the purchase was made and the e-mail address used when you placed your order.
If Toniton considers the product to be defective, you will receive a full refund including shipping costs.
Note: Do not return an item without first contacting Toniton. If you do, it may unfortunately mean that we can not reimburse the shipping costs.
Terms for complaints
A Customer who has purchased a Product as a private person has the right to submit a Product Complaint and return the Product if it is incorrect in accordance with the Consumer Purchase Act (1990: 932) and the Consumer Services Act (1985: 716). The law covers all original defects that have occurred within 3 years of receipt of the product. The warranty also covers defects that have occurred during shipping and transport (See below: 9.3 Complaints due to damage in transport).
The error must be reported as soon as possible after it is discovered. Reporting errors within 2 months of receiving Product is always considered a reasonable time. The customer must provide a description of what is perceived as defective, so that Toniton can take a position on the information. The customer must also contact Toniton in the event of a potential delay in information.
In the event of an approved complaint, Toniton is responsible for all costs, including shipping. A Product that does not comply with the Agreement that you have entered into with Toniton or in any other way is defective, will be considered a defect and a reason for complaint. Defects in a Product that the Customer has caused through negligent treatment, are not considered original and are therefore not reasonable to complain about.
If you as a Customer complain about a faulty Product 6 months or later from your delivery date, it is your responsibility to prove that the Product had an original defect. Toniton therefore recommends that you examine the Product / Products when they are delivered and report any defects as soon as they are discovered.
When you complain about a faulty Product, you as a Customer have the right to have the fault corrected or to have a Product free from defects in that Toniton still has the Product in its range. In some cases, you have the right to terminate the Agreement and cancel the purchase with full refund right. Once a complaint has been accepted, you will not be held liable for any costs incurred as a result of the complaint, such as the shipping cost of returning your order to Toniton. Please note that you as a Customer are obliged to minimize possible handling costs in the event that a Product proves to be defective.
Complaints about defects that have occurred during transport
All Products are carefully checked and packed by our warehouse. If you as a Customer should receive a damaged package, take a clear photo of the damage and contact us within 24 hours of receiving the products. Later reported damage is not recognized by the carrier. Therefore, always check the goods immediately upon receipt. If you discover any damage, please contact us at: email@example.com
ARN / EU ODR
Toniton follows the recommendations of the General Complaints Board (ARN) and the European Commission Online Dispute Resolution (EU ODR).

We reserve the right to invoke Force Majeure in situations where this is applicable. In such cases, Toniton is not liable for damages received by the customer.
Disclaimer for tax and fee changes
In the event of significant tax or fee changes, which are of great importance to this Agreement, Toniton has the right to terminate the Agreement. In these cases, the Customer is not entitled to receive financial compensation or other compensation from Toniton
Tonitons disclaimer for delayed delivery beyond our control
If a delivery is delayed, caused by an event beyond Toniton's control, Toniton shall not be held liable for any damage resulting from delayed delivery. In this case, the Customer is not entitled to receive financial compensation or other compensation from Toniton unless otherwise agreed between the Customer and Toniton or other provisions applicable under the law.
Reservation for the right of withdrawal
Toniton has the right to terminate the Agreement if the Customer has purchased a Product that for obvious reasons should not have been sold or where a clear error has occurred, such as incorrect prices or quantities. If the Agreement is terminated as a result, the Customer is not entitled to compensation or other compensation from Toniton.
Reservation for changes
Toniton reserves the right to change the content of toniton.com without prior notice, which includes, but is not limited to, the range, prices. The changes do not affect agreements already entered into between Toniton and Customer.
